Terms of Service
These Terms of Service ("Terms") govern your use of Asguard.app's website and services.
1. About These Terms
These terms of use ("Terms") govern your use of the Asguard service, including the Asguard website (asguard.app), the caregiver dashboard, the AI companion delivered via Telegram (and other supported messaging platforms), and all related features.
By creating an account, subscribing to the service, or using any part of Asguard, you agree to be bound by these Terms. If you do not agree, please do not use the service.

2. Definitions
- "Asguard", "we", "us", "our" — Fleur Lamont Ltd, the operator of the Asguard service
- "Caregiver" — the person who creates an account, subscribes, and manages the service on behalf of an elderly relative
- "Elderly user" or "user" — the elderly person who converses with the AI companion via Telegram
- "Companion" — the AI conversational assistant provided through the Asguard service, referred to by the personal name chosen by the caregiver
- "Family reader" — an additional family member added by the caregiver to receive memory digests
- "Service" — the Asguard application, website, dashboard, AI companion, and all related features
- "Content" — any text, memories, stories, health readings, or other information submitted through the service
3. Eligibility
3.1 Caregivers
To create an Asguard account, you must:
- Be at least 18 years of age
- Be a resident of the United Kingdom (the service is not currently available outside the UK)
- Have the authority and consent of the elderly person on whose behalf you are setting up the service, or have a reasonable basis to act in their interest (e.g. as a family member or appointed carer)
3.2 Elderly Users
The elderly user must be aware that the companion service has been set up for them and must not be coerced into using it. The elderly user may stop using the service at any time by ceasing to respond or by blocking the Telegram bot.
3.3 Geographic Restriction
Asguard is currently available in the United Kingdom only. Users in the United States are not eligible to subscribe at this time. US-based visitors may join our waitlist and will be notified when service becomes available.
4. The Asguard Service
4.1 What Asguard Provides
Asguard provides:
- Medication reminders — timed messages to the elderly user reminding them to take prescribed medications, with adherence tracking and caregiver alerts for missed doses
- AI companion conversation — daily warm, personalised conversation with the elderly user, including morning greetings, wellbeing check-ins, "This Day in History" features, cognitive stimulation activities (brain moments), and afternoon check-ins
- Memory and story preservation — detection and storage of personal memories shared in conversation, with user-controlled sharing to family members
- Wellbeing monitoring — classification of daily check-in responses and alerting caregivers to patterns of concern
- Clinical health recording — recording of self-reported health readings (blood pressure, blood glucose, etc.) shared voluntarily in conversation, with configurable caregiver alerts
- Crisis detection — monitoring of all messages for expressions of distress, with immediate caregiver notification and provision of crisis helpline information
- Family memory digests — weekly email summaries of shared memories to designated family readers
- Living Memoir — a compiled document of the elderly user's stored memories, available as PDF or printed book
- Caregiver dashboard — a web interface for managing medications, viewing wellbeing data, browsing memories, and managing account settings
4.2 What Asguard Is Not
Asguard is not a medical device. It does not diagnose, prescribe, treat, or provide medical advice. Medication reminders are informational only — the caregiver is responsible for ensuring medication information is accurate and current. Any health readings recorded are for informational purposes and should be reviewed with a qualified healthcare professional.
Asguard is not a replacement for human care. It is a companion and communication tool that supplements — never replaces — human relationships, professional medical care, or social services.
Asguard is not an emergency service. While crisis detection will alert a caregiver and provide helpline information to the user, Asguard does not contact emergency services. In a medical or safety emergency, call 999.
Asguard is not a clinical assessment tool. Brain moment (cognitive puzzle) results are engagement activities only. They are never shown to caregivers, and they do not constitute a cognitive assessment or diagnosis of any kind.
Asguard is not a surveillance tool. The elderly user has agency over what they share. Memory sharing requires their consent. Caregivers do not have access to private memories or raw conversation transcripts beyond what is surfaced through the designed alert and summary features.
5. Account Registration and Security
5.1 Account Creation
You must provide accurate and complete information when creating an account. You are responsible for maintaining the accuracy of your account information.
5.2 Account Security
You are responsible for keeping your login credentials secure. You must not share your password with others. If you believe your account has been compromised, contact us immediately at hello@asguard.app.
5.3 Caregiver Responsibility
As a caregiver, you are responsible for:
- Ensuring medication information entered into the service is accurate and up to date
- Responding appropriately to alerts and notifications (Asguard notifies — you act)
- Obtaining the elderly user's awareness and, where possible, consent before setting up the service
- Not relying solely on Asguard for medication management, health monitoring, or the safety of your relative
6. Subscriptions and Payment
6.1 Pricing
Asguard offers the following subscription tiers:

Additional add-ons (additional elderly users, additional family readers, printed memoir copies) are available at published prices.
Prices are in pounds sterling (GBP) and inclusive of VAT where applicable. We reserve the right to change pricing with 30 days' notice to existing subscribers.
6.2 Free Trial
New subscribers receive a 14-day free trial with full Family+ access. A valid payment method is required at sign-up. Your card will be charged at the end of the trial period unless you cancel before then. Email reminders will be sent before your trial ends.
6.3 Payment Processing
Payments are processed by Stripe. By subscribing, you also agree to Stripe's terms of service. We do not store your full card details.
6.4 Cancellation
You may cancel your subscription at any time through the account settings in the caregiver dashboard, or by contacting us at hello@asguard.app. Upon cancellation:
- Your subscription remains active until the end of the current billing period
- The AI companion will stop sending messages to the elderly user at the end of the billing period
- You will have 30 days after cancellation to export your data (memories, medication logs, health readings)
- After 30 days, account data will be deleted in accordance with our Privacy Policy (health records are retained for 7 years as required)
6.5 Refunds
If you cancel within 14 days of your first paid subscription (after the free trial), you are entitled to a full refund under the Consumer Contracts Regulations 2013. Beyond this statutory cooling-off period, subscription fees are non-refundable for the current billing period.
7. AI Companion — Service Limitations
7.1 AI-Generated Content
The companion's responses are generated by artificial intelligence. While designed to be warm, helpful, and contextually appropriate, AI-generated content may occasionally:
- Contain inaccuracies or factual errors
- Misinterpret the user's intent or tone
- Produce responses that are not perfectly suited to the situation
Asguard's "This Day in History" feature uses factual sources (such as the Wikipedia "On This Day" API) for grounding, but the conversational presentation is AI-generated and may not be perfectly accurate.
You should not rely on the companion for factual accuracy, medical information, legal advice, or any other professional guidance.
7.2 Conversation Limits
Daily conversation limits apply based on your subscription tier. When the limit is reached, the companion will respond warmly and in-character — it will not display a technical error. Crisis detection continues to function regardless of conversation limits.
7.3 Service Availability
We aim to provide the Asguard service continuously, but we do not guarantee uninterrupted availability. The service may be temporarily unavailable due to:
- Scheduled maintenance (we will provide advance notice where possible)
- Technical issues with our infrastructure or third-party providers (Telegram, AI services)
- Force majeure events beyond our reasonable control
We will use reasonable efforts to minimise downtime and to restore the service promptly.
7.4 Companion Name
The caregiver chooses a personal name for the AI companion. This name is used throughout the elderly user's experience. The companion is an AI service — not a real person. By choosing a name, you acknowledge that the companion is a software service operating under a personalised name.
8. User Content and Intellectual Property
8.1 Your Content
You retain ownership of all content you submit to the Asguard service, including conversation text, memories, stories, and health readings.
By using the service, you grant Fleur Lamont Ltd a non-exclusive, worldwide licence to use, store, process, and display your content solely for the purpose of providing and improving the Asguard service. This includes:
- Storing and retrieving memories
- Generating AI responses based on conversation history
- Creating the biographical profile used by the companion
- Generating the Living Memoir and family digests
- Generating text embeddings for memory retrieval
We do not use your content for advertising, marketing to third parties, or AI model training.
8.2 Our Content
The Asguard website, dashboard, companion responses, branding, and all original content produced by Fleur Lamont Ltd are our intellectual property and are protected by copyright. You may not copy, reproduce, or distribute our content without written permission.
8.3 Living Memoir
The Living Memoir is generated from the elderly user's words with light AI-assisted structure. The content belongs to the subscribing family. Fleur Lamont Ltd retains no rights over the memoir content after generation. You may print, share, and distribute the memoir freely within your family.
9. Acceptable Use
You agree not to:
- Provide false or misleading information when creating an account or entering medication data
- Use the service for any unlawful purpose
- Attempt to access another user's account or data
- Use the service to harass, abuse, or harm any person
- Introduce viruses, malware, or any harmful code
- Attempt to reverse-engineer, decompile, or extract the source code of the service
- Use automated tools (bots, scrapers) to access the service, except through the intended Telegram bot interface
- Resell or commercially exploit the service without our written consent
- Deliberately input content designed to manipulate, mislead, or exploit the AI companion
10. Crisis Detection and Safeguarding
10.1 How Crisis Detection Works
Asguard monitors all incoming messages from elderly users for signals of crisis, including expressions of hopelessness, self-harm ideation, or severe distress. This monitoring runs on every message, regardless of conversation limits.
10.2 What Happens When a Crisis Is Detected
If a crisis signal is detected:
- The companion responds warmly and directly to the user
- The companion provides the relevant crisis helpline number (e.g. Samaritans: 116 123) appropriate to the user's location
- The caregiver is notified immediately via email (and Telegram, if linked)
- The full conversation context is flagged for the caregiver's review
10.3 Limitations
Crisis detection is AI-based and is not infallible. It may miss signals or produce false positives. Asguard does not replace professional mental health support, emergency services, or human vigilance. If you are concerned about your relative's immediate safety, call 999.
11. Limitation of Liability
11.1 Service Provided "As Is"
To the fullest extent permitted by law, the Asguard service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the accuracy, reliability, or fitness for a particular purpose of the service.
11.2 Exclusions
To the fullest extent permitted by applicable law, Fleur Lamont Ltd shall not be liable for:
- Any harm or adverse outcome resulting from reliance on medication reminders, including missed doses, incorrect medication information entered by the caregiver, or delayed alerts
- Any medical condition, health event, or injury that occurs while using or not using the service
- Any distress caused by AI-generated content, including inaccurate statements, insensitive responses, or misinterpreted context
- Any loss of data due to circumstances beyond our reasonable control
- Any indirect, incidental, special, consequential, or punitive damages arising from your use of the service
11.3 Cap on Liability
To the extent permitted by law, our total aggregate liability to you for any claims arising from or related to the service shall not exceed the total amount you have paid to us in the 12 months preceding the claim.
11.4 Nothing in These Terms Excludes Liability For:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be excluded or limited under applicable law, including under the Consumer Rights Act 2015
12. Indemnification
You agree to indemnify and hold harmless Fleur Lamont Ltd, its directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your breach of these Terms
- Inaccurate medication information you entered into the service
- Your failure to respond to alerts or notifications
- Any misuse of the service by you or anyone accessing the service through your account
13. Data Protection
Your use of the Asguard service is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your personal data. The Privacy Policy forms part of these Terms. Please read it carefully.
14. Modifications to the Service
We may modify, update, or discontinue features of the Asguard service at any time. Where changes materially affect the service you are paying for, we will provide reasonable notice and, where appropriate, offer a pro-rata refund or the option to cancel without penalty.
15. Changes to These Terms
We may update these Terms from time to time. When we make material changes:
- We will update the "Last Updated" date at the top of this page
- We will notify active subscribers by email
- We will provide a summary of what changed
Continued use of the service after a Terms update constitutes acceptance of the revised Terms. If you do not agree with the changes, you may cancel your subscription.
16. Termination
16.1 By You
You may terminate your account at any time by cancelling your subscription and requesting account deletion. See Section 6.4 for cancellation details.
16.2 By Us
We may suspend or terminate your account if:
- You breach these Terms
- You provide false information
- Your use of the service poses a risk to other users or to the service itself
- We are required to do so by law
Where possible, we will provide notice and an opportunity to remedy the breach before termination. In cases of serious breach, we may terminate immediately.
16.3 Effect of Termination
Upon termination:
- The AI companion will stop sending messages to the elderly user
- You will retain access to export your data for 30 days (90 days for memories and stories)
- After the export period, data will be deleted in accordance with our Privacy Policy
17. Bereavement
We understand that some accounts will be closed because the elderly user has passed away. If this happens:
- Contact us at hello@asguard.app — we will handle your request with sensitivity and care
- We will offer a final export of all memories, stories, and the Living Memoir
- Where possible, we will offer a complimentary printed memoir at cost as a final gift
- We will not send standard cancellation or marketing communications in this circumstance
18. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Nothing in these Terms affects your statutory rights as a consumer under UK law, including the Consumer Rights Act 2015.
19. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
20. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Fleur Lamont Ltd regarding your use of the Asguard service.
